When the draft of this Ordinance was submitted for the approval of the Secretary of State it appeared to require reconsideration in certain particulars.

(1) Under Sec. ? Foreign ships which might break bulk and escape from Hongkong harbour were liable to seizure elsewhere than in the Colonial waters. This enactment was clearly beyond the competency of a Colonial Legislature.

(2) In sections 9, 10, a slight addition to include agents in citations for legal purposes, in cases where the owners of an inculpated ship in the Colony were absent, was thought necessary.

(3) Sec. 17 authorized the seizure of ships putting into Hongkong for stress of weather which had cleared out from a Foreign Port with Chinese Emigrants on board. This, in the case of Foreign ships, would have given rise to serious complications with the Governments of the Countries to which the ships belonged. Lord Kimberley
